Terms and Conditions of Sale

1. Object

These Terms and Conditions of Sale (TCS) govern the sale of RFID charging cards, vehicle connectivity and the billing of charging sessions for electric vehicles offered by:

2. Definitions

2.1. "RFID Charging Card"

Physical support allowing user identification on partner charging stations.

2.2. "Commission"

Fixed amount charged by Electus per charging session for transaction intermediation, displayed before any session.

2.3. "Customer"

Natural or legal person who purchases a Charging Card, connects their vehicle or performs charging sessions via the Electus application.

2.4. "User"

Personal account created by the User in the Electus application to access services. It must contain valid information (name, first name, email, address).

2.5. "Connected Vehicle"

Refers to a vehicle connected to the Electus application through a connectivity partner called Smartcar.

3. Order and Payment

3.1. Card Purchase

The Charging Card is sold via the Electus application or website. Its price is indicated during the order process.

3.2. SEPA Payment

Payment may be made by SEPA direct debit. By configuring this payment method, the customer explicitly authorizes Electus to debit the amounts due.

Payments may be triggered:

- during the month if the total amount reaches €50

- at the end of the month

- at any time during the month

All badges, charging sessions, and connected vehicle subscriptions are due by the Customer.

3.3. Card Payment

Payment may be made by bank card charge. By configuring it on the Electus application or website, the customer explicitly authorizes Electus to debit the amounts due.

Payments may be triggered:

- during the month if the total amount reaches €50

- at the end of the month

- at any time during the month

All badges, charging sessions, and connected vehicle subscriptions are due by the Customer.

4. Delivery & Activation

The Charging Card is sent by post. In case of non-receipt due to an incorrect address, the card must be repurchased.

Delivery times for the charging card are indicative and may be longer without justification.

The received Card must be activated via the Electus application before any use.

5. Connected Vehicle Subscription

5.1. Subscription Period

The subscription period for the connected vehicle service runs from the first to the last day of the month. In case of subscription mid-period, the subscription will be calculated on a pro-rata basis for the remaining days.

Any subscription period that has begun is due.

5.2. Data Retrieval Frequency

The frequency of vehicle data retrieval depends on the vehicle's transmission, the vehicle manufacturer, and the transmission provider, Smartcar.

Electus does not guarantee any update frequency.

5.3. Vehicle Connection Issues

In case of connection issues with your vehicle or account blocking, you must contact the vehicle manufacturer.

Electus acts as a billing intermediary between Smartcar and the customer; any connection issues are the responsibility of the vehicle manufacturer.

Unless Smartcar acknowledges an obvious issue on their part, Electus will not refund an initiated subscription.

6. Session Pricing

Before any charging, the User must check the charging price and commission displayed on the charging station page. If this information is not displayed, the User must not start the session. Electus cannot be held responsible for a charging session performed without prior information on rates.

If an error is identified on a charging session (including but not limited to incorrect data returned by the charger or the operator), the amount of the session may be recalculated before the direct debit, based on corrected information.

For billing purposes, energy (kWh) values are rounded up to the next whole unit and time (minutes) is rounded up to the next whole minute, unless the charging point operator applies, under its own pricing terms, a stricter rounding method, in which case that rounding applies.

7. Right of Withdrawal

The User has 14 days to withdraw after purchasing the Card. The request must be made via the dedicated form in the application, and the Card must be returned complete and in good condition.

This right does not apply to charging sessions already used.

This right does not apply to connected vehicle subscriptions already taken out.

8. Badge Use

8.1. Blocking/Unblocking

The User can block or unblock their badge via the application or by contacting support.

All charging sessions initiated remain due, even after blocking.

8.2. Loss or Deterioration

In case of loss or deterioration of the badge, a new badge must be purchased.

8.3. Validity

The badge is valid for 2 years. Electus may deactivate a badge with prolonged inactivity, reactivable via the application.

9. Affiliation

The User can obtain a fixed commission of €1 including tax per card sale generated via their affiliation code (non-transferable). This gain can only be used in the Electus application and is valid for 1 year from receipt.

Commission earnings are only paid upon receipt of the sale funds.

10. Payment and Payment Default

10.1. Payment Failure

In case of non-payment, the customer must contact Electus on their own initiative upon receiving notification of non-payment. In the absence of a response from the customer within 7 calendar days, late fees of €40 will be charged to the customer and a recovery procedure will be initiated.

Upon receipt of a non-payment, all charging badges will be blocked until the situation is resolved.

To cover administrative costs, each rejected payment attempt will be charged €5 including tax.

10.2. Recovery

In the absence of a response from the customer within 7 calendar days after the notification email, Electus reserves the right to contact the customer by registered letter before initiating a payment order.

In the case of contact by registered letter or the initiation of a payment order, all such costs will be added to the amounts to be settled.

10.3. Late Payment Penalties

Without formal notice, the customer will be automatically liable: - for a penalty calculated at three times the legal interest rate in force on the due date - for a fixed compensation of €40 per unpaid invoice for recovery costs.

10.4. Badge Cancellation

Electus reserves the right to cancel a charging badge in case of suspected repeat non-payment.

Badge purchase costs will not be refunded.

11. Liability

Electus acts only as an intermediary with charging station operators. The station owner is responsible for its operation. Electus cannot be held responsible for malfunctions of the stations themselves.

12. Data Protection

Electus processes personal data in accordance with GDPR. The User has the right to access, rectify and delete their data.

13. Fraud

In case of suspected fraud (by the User or the payment provider), Electus may suspend the account until clarification.

14. Applicable Law and Disputes

These TCS are governed by French law. In case of translation, the French version prevails.
